Data Processing Annex
This Annex forms part of the Terms. It applies whenever Adstyr processes personal data on your behalf as your processor (GDPR Article 28, and the Israeli Privacy Protection Law and its Data Security Regulations). You are the controller of that data; Adstyr is the processor.
- Subject matter and duration: Providing the Service to you, for as long as your account is active and until the data is deleted as described under End of processing below.
- Nature and purpose: Collecting, storing, displaying, sending and deleting data through the features you use: the lead list and lead notifications, the social inbox and comments, and campaign management. Adstyr uses this data only to provide the Service to you, never for its own purposes.
- Types of personal data: Contact details your leads submit (such as name, email address, phone number and answers to your form questions), messages people send to your Pages, and comments on your posts, including the names and IDs of the people who wrote them.
- Data subjects: Your leads, customers and contacts, and people who message or comment on your Facebook Pages and Instagram accounts.
- Instructions: Adstyr processes this data only on your documented instructions, which are these Terms and the settings and actions you choose in the Service, unless the law requires otherwise. In that case we will tell you first, unless the law forbids it. We will tell you if we believe an instruction breaks data protection law.
- Confidentiality: Everyone at Adstyr who can access this data is bound by a duty of confidentiality.
- Security: Adstyr applies the technical and organisational measures described on our Security page, including encryption in transit and at rest, access control and logging (GDPR Article 32).
- Sub-processors: You authorise Adstyr to use the sub-processors listed in section 5.1 of our Privacy Policy. Each is bound by written data protection terms at least as protective as this Annex. We will announce changes to that list before they take effect, and you may object. If we cannot address a reasonable objection, you may end your subscription.
- Assistance: Taking into account the nature of the processing, Adstyr will help you answer requests from people exercising their data protection rights, and with your obligations on security, breach notification, data protection impact assessments and prior consultation (GDPR Articles 32 to 36).
- Personal data breaches: Adstyr will notify you without undue delay after becoming aware of a breach affecting this data, with the information you need to meet your own notification duties.
- End of processing: When you delete your account or remove an ad account or Page, Adstyr deletes this data as set out in the Privacy Policy, unless the law requires us to keep it. You can export your data before then from your account settings.
- Audits and information: Adstyr will make available the information needed to show compliance with this Annex, and will allow for and contribute to reasonable audits, including inspections, by you or an auditor you appoint, with reasonable notice and at your cost.
